Accidentally Released Inmate Now Back in Custody at Floyd County Jail

FCSO - Nixon 2An inmate at the Floyd County Jail no doubt felt that he’d been given an early Christmas present, when he was released from jail the day before Thanksgiving.

The problem was – it was a mistake.

50 year old Frank Nixon had been sentenced earlier in the week to 10 years in prison followed by 10 years probation on a felony theft by shoplifting charge, however his sentence had accidentally been listed as 10 years probation only, so – he was released from custody.

Once deputies realized their mistake, they went to the address listed for Nixon, where they found him sitting on his front porch – seemingly quite content.

Nixon has since had a charge of escape filed against him; Deputy Chief Tom Caldwell stated that Nixon should’ve known he had 10 years of time to serve, but decided to walk out of jail anyway.
