Former Owner Of The Cherokee Memory Gardens Sentenced On Charges Of Theft By Deception

A former Cherokee County business owner has been ordered to serve one year in the Cherokee County Detention after being convicted of two counts of Theft by Deception in the 1st Degree and one count of Theft by Deception in the 2nd Degree.

66 year old John Charles Usry, the former owner of Cherokee Memory Gardens was sentenced in the Courtroom of Circuit Judge Shaunathan Bell.

According to court documents obtained by WEIS Radio News, Usry was sentenced to 46 months split to serve 12 months in the Cherokee County Detention Center each to run concurrently with the other. Usry was ordered to pay $29,920, $1,150.50 in restitution and $587.00 in bail bond fees.

Usry’s sentence will be followed by 60 months probation and he was given credit for 3 days served in jail.

Usry was arrested back in 2017 involving cases where he did knowingly obtain by deception control over checks, currency or the property of a named individuals with the intent to deprive the owner of said property at the Cherokee Memory Gardens involving the sale of preneed burial plots, markers and the opening and closing of grave-sites in violation of Section 13A-8-3 of the Code of Alabama.
