A Gadsden lawyer, 60 year old John Davis McCord, and his 59 year old wife, Susan, who acts as his administrative assistant, currently stand charged with Theft by Deception 1st Degree in connection with a reported case of theft from a client.

The investigation began several weeks ago, after the 47 year old victim filed a report telling police he was cheated out of more than $3,000.

According to reports John McCord represented the victim in a current divorce/custody case and the couple allegedly told the victim he was the subject of a criminal investigation by the Etowah County District Attorney’s Office – therefore, an additional retainer fee to represent the victim regarding the criminal investigation was needed.

However according to police the victim learned from the Etowah County District Attorney’s Office personnel that he was NOT under investigation.

As a result of the police investigation into the matter, the McCords were arrested Monday on Theft by Deception 1st Degree charges – a Class B felony. 

They were booked into the Etowah County Jail and released a short time later after posting bond of $5,000 each.
