The defense requested that statements made by Allen be thrown out. Some were and some were not. The judge refused to allow statements made by Allen at the hospital and to a Department of Human Resource Investigator.

The judge did allow statements made by Allen to a Sheriff’s Department Investigator that he made both before his arrest and the one he made the day after his arrest.

Investigators believe the child died from blunt force trauma to the head. The mother of the child, 24-year-old Bridgett Duncan, was also initially charged with aggravated child abuse.

Those charges never came to pass after a Marshall County Grand Jury failed to indict her.

Jury selection begins Monday afternoon.

Prosecutors believe that process will continue until Wednesday morning when a jury will be seated and opening statements begin.
