Kelly Jack Mayo Pleads Guilty to Two Counts of Attempted Murder

MayoThe individual accused of shooting two people at Fred’s Department Store in Rainsville in 2012, has pled guilty to two counts of attempted murder in connection with the incident.

The Ft Payne Times-Journal reports that Kelly Jack Mayo entered that plea last Thursday (March 6th) as part of an agreement between himself, his attorney, the DeKalb County DA’s Office and his two victims.

Mayo was sentenced by Judge Randall Cole to 25 years in prison on each count, with those terms to be served concurrently; Mayo was also ordered to pay court costs and restitution to the victims – Josh Nance and Mathew Whitt – in an amount to be determined later.

Nance and Whitt were in the process of closing the store on the night of August 24th, 2012 when they were shot through the front glass windows of the store; both were shot in the back and were forced to undergo extensive rehabilitation.   

District Attorney Mike O’Dell stated that the shooting was part of what turned out to be a failed robbery attempt, and Mayo still faces charges in connection with an alleged robbery attempt that took place at a Fred’s store in Cedartown, Georgia.
